Terms of Service

Effective

These Terms govern your use of Gud w it, operated by Presten R. Montero (“we,” “us,” or “our”). By creating an account or using the app, you agree to these Terms. If you do not agree, do not use Gud w it.

1. Eligibility and accounts

You must be at least 13 years old to use Gud w it. Users under 18 must have a parent or legal guardian review these Terms and permit their use of the app. Users must be at least 21 to enter or purchase from venues that require it. Gud w it recommends 21+ because it focuses on nightlife, but does not itself sell alcohol or require users to make purchases.

Provide accurate account information and keep your credentials secure. You are responsible for activity on your account.

2. What Gud w it does

Gud w it helps users discover nightlife venues and events, view crowd reports, submit crowd-level reports with short comments, and indicate interest in events. The app is launching in San Diego, California.

Venue details, event listings, and user reports may be incomplete, outdated, or inaccurate. Crowd levels can change quickly. Do not treat app content as a guarantee of venue conditions, event availability, admission, safety, or age requirements. Confirm important details with the venue.

3. User content and conduct

You retain ownership of comments and other content you submit. You give us a non-exclusive, worldwide, royalty-free permission to host, display, and use that content as needed to operate, maintain, and improve Gud w it.

Do not submit unlawful, threatening, harassing, discriminatory, deceptive, or privacy-invasive content. Do not impersonate someone else, interfere with the app, or use Gud w it to promote illegal activity.

We may review, remove, or restrict content or accounts that violate these Terms or create safety, legal, or operational concerns. You can contact us about app content or account issues at the email below.

4. Account deletion and data

You may initiate account deletion through Account in the You section of Gud w it. Deleting your account will delete the account and associated user data and content, including your profile information, crowd reports and comments, event-interest records, saved favorites, and appearance preference on this device.

We may retain information where the law requires or permits it, or where it is reasonably necessary for security, fraud prevention, or legal claims. Information in backup systems may take additional time to expire. Any information retained will be limited to the applicable purpose and handled as described in the Privacy Policy.

5. Third-party services and venues

Gud w it relies on third-party providers for app functionality, including Supabase and, if you sign in with Google or Apple, that company. Those providers may have their own terms and privacy practices. Venue and event links may take you to third-party services that we do not control.

Gud w it is not affiliated with, and does not endorse, every venue or event listed in the app.

6. App availability and disclaimers

We may update, suspend, or discontinue features. Gud w it is provided “as is” and “as available.” To the extent permitted by law, we disclaim implied warranties and are not responsible for indirect or consequential losses arising from use of the app. Nothing in these Terms limits rights or remedies that cannot legally be waived.

7. Disputes and arbitration

Before starting arbitration, you and we agree to try to resolve the dispute informally. Send a description of the issue and the requested resolution to support@gudwit.com. If it is not resolved within 30 days, either party may start arbitration.

Except for eligible matters in small claims court, disputes relating to Gud w it or these Terms will be resolved by individual, binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The hearing may be remote or, if an in-person hearing is needed, held in San Diego County, California, subject to applicable law. The arbitrator may award the same individual relief a court could award. The parties will share fees as required by the AAA rules and applicable law.

To the extent permitted by law, disputes must be brought individually, not as a class, collective, or representative action. You may opt out of this arbitration section by emailing support@gudwit.com within 30 days after first accepting these Terms, with the subject “Arbitration Opt-Out” and the email address on your Gud w it account.

8. California law

California law governs these Terms, except where federal law or another applicable rule requires otherwise. This section does not prevent a user from exercising rights that cannot legally be waived.

9. Changes to these Terms

We may revise these Terms as Gud w it changes. We will post the updated version in the app and update its effective date. Where required, we will ask you to accept material changes before continuing to use the app.
